Agreement to Terms

By accessing or using FunnelsInsights ("Service"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service.

Use License

FunnelsInsights grants you a personal, non-exclusive, non-transferable, limited license to use the Service for your business purposes, subject to these Terms.

You May Not:

  • Modify or copy the Service materials
  • Use the Service for any commercial purpose without a paid subscription
  • Attempt to reverse engineer any software contained in the Service
  • Remove any copyright or proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server
  • Use the Service in any way that violates any applicable laws or regulations

Account Responsibilities

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for:

  • Safeguarding your account password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your use complies with all applicable laws

Subscription and Billing

Paid Subscriptions

Some parts of the Service are billed on a subscription basis. You will be billed in advance on a recurring and periodic basis (monthly or annually).

Auto-Renewal

Unless you cancel your subscription, it will automatically renew at the end of each billing period. You may cancel your subscription at any time through your account settings.

Refunds

We offer a 14-day money-back guarantee for new subscriptions. Refunds beyond this period are at our sole discretion.

Fee Changes

We may modify subscription fees at any time. We will provide at least 30 days' notice of any fee changes, and changes will take effect at the start of the next billing cycle.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as outlined in our Privacy Policy.

Your Data

You retain all rights to the data you input into the Service. We claim no ownership over your business data. You grant us a license to use your data solely for the purpose of providing and improving the Service.

Data Security

We implement reasonable security measures to protect your data. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.

Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe upon the rights of others
  • Transmit any malicious code or harmful materials
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers
  • Use the Service to send spam or unsolicited communications
  • Scrape or harvest data from the Service without permission

Third-Party Integrations

The Service integrates with third-party platforms (Shopify, Meta Ads, Google Ads, etc.). Your use of these integrations is subject to the respective third party's terms of service. We are not responsible for any third-party services or their content.

Intellectual Property

The Service and its original content (excluding your data), features, and functionality are and will remain the exclusive property of FunnelsInsights and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected

Limitation of Liability

IN NO EVENT SHALL FUNNELSINSIGHTS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

Indemnification

You agree to indemnify and hold harmless FunnelsInsights and its affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may do so by contacting us or through your account settings.

We will retain your data for 30 days after termination, after which it will be permanently deleted unless required by law to retain it longer.

Modifications to Service

We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service at least 30 days prior to the changes taking effect.

Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in court.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
